Apple Wins Appeal Against Epic Games Over App Store Policy
The United States Ninth Circuit Court of Appeals recently ruled in favor of Apple’s App Store policy filed by Epic Games. According to them, the policy does not violate the federal antitrust laws that Epic Games filed.
This latest decision is another blow to Epic Games in its ongoing dispute with Apple regarding the 30% cut taken from in-app purchases. The dispute resulted in Fortnite being removed from the App Store.
Although Apple won, the court revealed that the App Store violated California’s unfair competition laws. These violations eventually resulted in an injunction that forced Apple to allow developers on its platform to link to payment options outside of their apps.

Today’s decision reaffirms Apple’s resounding victory in the case, with 9 out of 10 claims having been decided in Apple’s favor. For the second time in 2 years, a federal court ruled that Apple complied with antitrust laws at both the state and federal level. The App Store continues to foster competition, drive innovation, and expand opportunity, and we’re proud of its great contribution to users and developers around the world.
We respectfully disagree with the court’s decision on the one remaining claim under state law and are considering further review.

Apple won in the 9th Circuit Court. Although the court upheld the decision that Apple’s restrictions had “substantial anticompetitive effects that harm consumers”, they ruled that we did not prove our Sherman Act case.
Fortunately, the court’s positive ruling against Apple’s anti-control provisions frees iOS developers to send consumers to the web and do business with them directly there. We are working on the next steps.
